if i didnt put the biological fathers name on the birth cirtifacate would he still have to sign over his rights befpre someone else can adopt her

  1. Yes,he still has to give his consent.But if he is not interested in the baby then no.

If you know who the father is, he should have a paternity test done and sign his rights away also.  I would be leary of adopting a baby if both parents did not sign the proper paperwork.  He could come back after she has been placed, and decide he wants to parent her and there would be nothing you could do once you sign your papers.  Each state is diffrent on how long he has to register on the punitive parent list.  I have always felt honesty is the best for everyone.

  4. Yes- you should have him sign something.  If you don't, he could change his mind and that would be bad for everyone, including your child.  Be responsible and get it taken care of now.  It will come back to haunt you.

Depending what state you are in, there could be a law called the punitive father registry.  In our state, and many others, after 10 days, if a man doesn't claim the child in writing at the courthouse, he stands a chance of losing it, although it doesn't sever his responsibilities to pay child support.  I have a listing at the house that says which states if you e-mail me with yours.

  7. I know this is bad but, my daughters biological father has never found he is a father. He is a drug addict, alcoholic who smokes a pack a day. My husband just adopted her. They didn't ask for anything. We just went in together and my daughter was calling him dada. No Problems.

  8. Talk to a lawyer or the agency to see what rights you have. If he doesn't want anything to do with the child, why would it be a problem for him to sign over his rights?

    In some states, there is a PUTATIVE father registry. If the guy doesn't sign it, he has no rights. Laws vary from state to state though.


  9. then the child is yours alone and can be adopted by someone responsible, unless the guy changes his mind about being a dad and exercise paternity rights.  having his name on the birth certificate has little to do with it because he could technically claim paternity and prove it with DNA testing.

  10. if u put the father is unknown then technically no they will ask you every one you have slept with and then they will try to find those guys to see if they are interested in parenting the child if nobody comes forward after a certain period of time then you do not need a fathers signature

  11. i believe the laws vary from state to state but the most legally sound thing to do would be to get him to sign a surrender/consent agreement.  in new jersey, you can make an adoption plan without naming the birthfather.  but then the adoption/placement could be disrupted if he finds out about it and decides he wants to parent.  so the safest bet... so not to disrupt your child's placement... would be to get him to sign a surrender agreement.  

    also, i would speak with an adoption counselor to make sure that this is the best decision for you and your child right now.  make sure that you've thought through all of your options before making an adoption plan.  call a local adoption agency.  if you start to feel any kind of pressure from them...  call another one.  this should be your decision to make and you need to be comfortable with it and have the support in place either way.
