Advanced Parole?

My green card is processing, but I need to go back to Europe before then because my baby sister died.

When I go to the US immigration building will they give me advanced parole for leaving the country for 1 month?

I really need to go as all my family is there, do I need any documents of proof?

Maybe a death certificate?

  1. What status were you on before you started to adjust status? If you were here on an H1B or L1 Visa you can travel without advanced parole, and it won&#039;t affect your application.  Go to USCIS.gov and it is explained there under emergency travel.

    Copied from USCIS website:

    The following individuals, who have a pending application for adjustment of status, may depart the United States without an advance parole document and without having their adjustment-of-status application considered abandoned:

    Individuals in H-1B (Specialty Workers) and L-1 (Intracompany Tranferee) status, and their dependents (H-4 and L-2), who maintain their status and possess valid visas;

    Individuals in V-2/3 visa status who maintain valid V nonimmigrant status and possess a valid V visa or who will obtain a V visa before applying for readmission to the United States;

    Individuals in K-3/4 nonimmigrant status who have maintained their status and possess a valid nonimmigrant visa or obtain a valid K-3/4 nonimmigrant visa before applying for readmission to the United States. (Note: Upon returning to the United States, you must present your valid H, L, K, or V nonimmigrant visa and continue to be eligible for that status.)

    Refugees and asylees who have applied to adjust to permanent resident status under section 209 of the Act may travel outside the United States on a valid Refugee Travel Document and do not need to apply for an advance parole document.


  2. sorry to hear about your sister, but the uscis has changed it&#039;s procedure on issuing advance parole documents, before all you had to do was present proof the emergency and they would issue the document on the same day, now it has to be applied for in chicago,il by mail or e-file. you will need the death certificate and both your birth and your sister&#039;s birth certificate to establish the relationship, you can request expedited service but it still will take time. good luck

    if you had 180 days of unlawful presence before applying for adjustment you could be subject to a 3-10 year bar from adjusting status if you leave the u.s.
