Advice regarding a lease?

Ok so I've lived at my apt for like 3 years now. Recently I have ran into some financial problems. My apt was cool about it and had me get a notarized letter stating I would pay by the 18th. Well that's tomorrow and I still don't have all of it. Plus I'm not going to have September's if I pay this months. Ahhhh My dad took it upon himself to get me an apt right by campus in his name. Its ready as of the 20th. So what should I do. I'm scarred about what is going to happen tomorrow when I don't have the funds? Can they do anything like lock me out?? I need until the 22nd at least.

  1. Legally they are not supposed to lock you out, but it sometimes happens.  Move into your dad's apartment on the 20th.  Meanwhile give your present landlord a written notice with certified mail return receipt.  Send the receipt to your new address.  Tell the old landlord that you do not have the money to pay them and you are moving on _______.  This will force the landlord to try and rent the premises for the fall semester.  He should have no problems renting it.  You will owe money for the unpaid rent.


  2. They can't lock you out but they can sue you for unpaid rent.  

  3. take the money you need and pay them the rest if they accept it then nothing to worry about. if they don't then they got to go to the courts and get a eviction notice which has to be served by a sheriff that take around a week then a bout a month from that notice to take u to court

  4. I would think that the thing to do is to act like an adult and go tell the manager / landlord the TRUTH.

    Tell them that you will make payments on the balance of what you owe them ....

    IF you run out; you can be liable for a lot more than you will if you act maturely about all of this ..

    Just so you know; NO they cannot lock you out until there has been a legal eviction ... and even then; you are able to get your possessions.

  5. You owe the rent, even if you are moving out.  If you skip out on the rent, you will probably be sued.  

    You can be help liable for the back rent, plus rent until the apt is leased. You can be held liable for all collection costs. The case becomes public record.  When you lose, it goes on your credit report. Plus, the landlord can tell anyone they want. That includes the school.  So, you will hurt yourself for quite some time. It could also make you ineligible for student loans, financial aid, etc.

    The court case will show up in background check when apply for job, etc. It could make you ineligible to be hired.

  6. If you're in California, there is no AUTOMATIC LOCK OUT by law.  No way.

    FIRST comes a Three day notice to pay or quit.

    THEN comes a formal lawsuit called an Unlawful Detainer.

    Then you get, like 20 days to file a legal answer.

    Then you go to Court.

    Then the judge decides.

    Then you get a few extra days to move your stuff.

    If you get automatically locked-out (California), call the police or sherriff.  Once they show up to the rental, tell them you're late, but have been locked out.  They'll tell you the place is STILL YOURS.  Ask the landlord to open it.  If they don't, call a lock smith, break a window,. just GET INSIDE YOUR RENTAL.  It's still yours.  Ask the police if you don't believe it.  

    You still have plently of time to technically PAY UP before any official eviction gets on your record.  Hurry.  Good luck.
