  1. If there is evidence  enough to charge, there may be enough to convict. An innocent man will say so and work to prove it.


  2. He is not required to prove his innocence.  It's up to the state to prove his guilt.  One of two things will happen.  He'll be acquitted and go free, or he'll be convicted and go to prison.  Whether or not he did it isn't important.  The state apparently thinks it has enough evidence to prove that he did.

  3. I was a juror on a case where the defendant was charged with first degree murder in a drug gang killing because he would not cooperate with the police and refused to plea bargain. The evidence was   not very convincing and the trial resulted in a hung jury  in three separate trials and he was eventually released.

    Edit" Half the jurors felt that if he were innocent  he would have talked to the police and voted to convict, and half followed the instructions that we should not make that assumption.
