If i enter the US with an immigrant visa, do I still have to file I-485 or will I receive my green card automatically.
background info.
My husband (US citizen) and i have been living in indonesia and currently applying to get an immigrant visa. I notice that the process is a bit different.
in 2004 i have applied for green card and was approved. at that time we had to file 1-130, 485, 175 and other docs all at the same time and it went pretty smooth. i got work for permit injust a couple of months and i got my green card in less than a year.
but we left the US and live in my country for over a year and my green card was revoked. now i need an immigrant visa to go to the US because we are planning to reside there.
im still confused of what is the difference between applying for an immigrant visa and filing I-485.
because so far i havent been instructed to file the I-485. what i have been instructed so far is filing so far is I-130, and a immigrant visa form which is about $400 so I can enter the US as an immigrant.
the process this time is done one by one (unlike when i was in the states in 2004 when we put everything, with medical exam and I-175 all in one big envelope)
and then whats next?
does that mean when filing from overseas (like in my case) the immigrant visa is equivalent to the i-485?
any help based on your experience is appreciated, or any link that may state something relating to this case.
thank you
