After signing an apartment lease in Ohio, is there a grace period to get out of it.

Mant. is refusing to fix the air and a leak we have under the sink, both of which are emergency calls according to our lease.

  1. Nope.  You are committed to the length of the lease.  Send a registered letter to management concerning the problems and how long you have waited for repairs.  This documentation will be  a benefit to you when your lease expires and management tries to keep your security.

  3. There is no grace period or "cooling off" period required by law for signing a lease.

    Once signed, it is a legally binding contract.

    The only way to get out of it is to prove that the apartment is not fit for human habitation. Your issues do not fall into this category.

    You need to follow Ohio's landlord/tenant laws regarding requesting repairs and follow the steps exactly as written per the law.

    Air conditioning is NOT an emergency repair. Air conditioning is not required in order for the place to be habitable.

    A leak is an emergency and should be taken care of, but it is not a legal cause to break the lease.

    Withholding rent without following the correct process will get you evicted.

  4. You can put your rent in escrow, not very expensive-you can go to local court house and get the forms. Once they stop getting rent payments they come around real quick.  DOCUMENT ALL calls, letters or converations you have with your landlord, it helps if you need to go to court. Also it could be a health hazzard if you are leaking water under your sink-it is considered grey water-call the health dept too.

  5. No - you cannot break a lease for things needing to be fixed and you cannot withhold rent either.

    Send them a certified letter of what needs to be fixed, they then have 30 days to get it done. If it is still not fixed you can have a licenced contractor fix it and take only that amount off the rent and make sure to keep all receipts.
