I do not know how the people who said "NO", actually know the answer since you did not provide the state that you live in.

Each state has different age of consent laws.  And yes, in some states, the age DOES start at 13.

Therefore, in order to correctly answer your question, you need to provide the state you live in.  Just remember, each state is different!  So, if it is legal in your state and the sexual acts happen in another state where it is against the law, then you can be in trouble.

This is what your state's law says, "§ 3122.1. Statutory sexual assault.

Except as provided in section 3121 (relating to rape), a person commits a felony of the second degree when that person engages in sexual intercourse with a complainant under the age of 16 years and that person is four or more years older than the complainant and the complainant and the person are not married to each other."

So, it would be considered illegal.

First of all no thirteen year old should be having s*x.  They are still figuring out who they are.

If you truly care about this person wait for her ( It is a her right?)

Make yourself respect her and it will pay off in the long run.
