Age of consent in Tasmania.....?

I know the age of consent is 17 in Tassie.. But just out of curiosity..

Say for example a 17 year old female was to have consensual s*x with a male in his 30's or 40's would it be illegal on his part because he's so much older than her and she's under 18..?

Also, if it is illegal, what would be his punishment if she or her parents were to press charges? I'm guessing a prison term but for how long?

  1. Ummm no the age your allowed to have s*x is 16 yrs old so if this chick is 17 and she has s*x with a much older guy its legal.  


  2. I thought that it was 16. That was what I was told when I was in the Navy, they specifically told us that the age of consent was 17 before we pulled in to port in Hobart. If it is 17 then I knew a few guys who could have ended in Boggo Road if they got caught. Me I was 19 and ended up with a 38 year old woman so I think I was in the clear.  

  3. It would be illegal on his part because she is a minor and he is the responsible adult. Yes there would be a punishment as it is considered statutory rape.

    It is an offence in Tasmania to have sexual intercourse with a person under the age of 17 (Criminal Code Act 1924, s13-124). However it is a defence if no anal s*x occurred and the younger person was of or above 12 years and the older was not more than 3 years their senior or, if no anal s*x occurred and the younger person was of or above 15 years and the older was not more than 5 years their senior ([2] and s13-124(3)).

    However as there is clearly a larger age gap than this a punishment would occur.

    However Tasmania is more lenient than the rest of the Australia.

    And each punishment is individualised not standardised.
