Alberto Contador has very low success rate if he decides to appeal, Legal experts
Court of Arbitration of Sport handed a two-year ban to the Spanish cyclist, Alberto Contador. The cyclist now has less than 30 days to appeal against the decision but it has been pointed out by the legal experts that such an action has very less chances of success.
Sports & Media Group lawyer, Jonathan Walters told Cyclingnews that the cyclist will have to submit the documents with the Swiss Federal Court within the defined period of 30 days.
He explained, “It all depends on if Contador has the appetite to continue, but his reaction in terms of maintaining his innocence was what I expected from yesterday’s press conference”.
Walters briefed that the Swiss court will look into the CAS decision and will not proceed with the appeal until they find any inappropriate evidence during the procedure.
UCI came to a conclusion that Contador used clenbuterol during the Tour de France 2010 and banned him from professional cycling for a period of two years.
The cyclist argued that the substance found in his blood sample was because of the contaminated beef that he ate during the race but was overturned by CAS.
Both UCI and WADA also claimed that Alberto was involved in blood doping during the past years but the issue was never raised during the hearing.
Jonathan cited, “What was a bit surprising was that the UCI tried to suggest its blood doping theory. I think that made it a lot more complicated”.
“Normally a sport’s governing body does not need to say why the substance got there, usually it’s up to the athlete,” he continued.
The decision now prohibits the cyclist form the major cycling events in the coming season, including the Tour de France, Giro d’ Italia and the 2012 Olympic Games.
He has also been disqualified from a number of wins, including the overall victories at the Tour de France 2010 and the Giro d’ Italia 2011.
It is still unsure if the Spaniard will appeal against the CAS decision, as his legal mates are still looking into the matter to collect as much information as possible.
Contador’s brother and the General Manager Fran Contador revealed that Alberto will rejoin the Danish side, Team Saxo Bank after serving the ban period, until August 2012.
