Alright I need a legal point of view about my situation...please?

Okay, so I met this girl on craigslist, we trade purses a few times, well I got a purse from her on sunday, and told her I would send her one when I got it this week. Well turns out I didnt get the one I was supposed to from someone else. So I told this girl, that I would send her the purse back bc i couldnt back up my part of the deal, and i told her I didnt have the money to pay her for it. she said she doesnt want it back, so i offered to trade her a few other purses, and she declined, and I said the only thing I can do is return yours then, Now she is saying she is going to take me to court bc we had a verbal agreement and all this crazy ****, Yes, We were supposed to trade, but I told her I couldnt get the other purse, So I would give her the one back. well she is not having it and freaking out on me. I contacted my local police department and they said to return it certified mail so i have proof. Also, she lives in delaware and I live in pa, I am down in delaware for the summer but returning in a week, if that makes any differnece

can she really take me to court over a purse? like I just shipped her the one back, so can she still take me even if I returned it?

  1. Take some pictures of the darn thing before you send it back  .Insured, certified and return receipt requested . There is something very wrong with that person . I hope there is a lesson learned here for you ! Stay away from interactions with strangers on the internet .

  3. No, if you have certified shipping information that the purse was sent back to her, she won't have anything against you in court. Just keep that information in case she decides to go a-wall on you.

  4. she can take you to small claims court, your best bet is to follow the police dept suggestion and send it certified return receipt requested. Dont go see this person, she sounds unglued and it could lead to bigger problems. also send a letter again Certified return receipt requested stating that you werent able to get the promised purse and you are returning the purse she sent you.


  5. I don't think that she will, I think that it is an empty threat. I would do as the police suggested, return it certified mail, then that is proof. She can't get you because there is no written proof. You did not steal it, you returned it, and I don't think that the courts will like to be bothered with this piddly little c**p. She can threaten you all she wants. When she gets the purse back, she won't have anything on you. Don't worry about it. Don't deal with her anymore either.

  7. Don't worry she doesn't have a case to sue you over a verbal agreement and you sent her the purse back. Since you live in pa she would have to come to pa to file a law suit against you and I doubt that she will. Even if she does, she doesn't have a case.

  8. what you have seems to be an "offer" &  " Acceptance", which is legally binding, although i speak from English Law...i dont know how US or federal law statutes cover this type of transcation. But with most verbal agreements there should be ways out of them... Im sure in the US you will have similar to us in the UK; a Citizens advice centre where you can get free legal advise..failing that there should be lots of free online legal help

  9. She can try but it will cost her more money than its worth, and she'd probably lose.

    Ignore her and she'll eventually go away.
