Also Have Swarm Around Tree, No Blossoms No Fruit For Weeks At a Time?

I also have a swarm around a tree. Though I have called pest control they say there is no nest, however I don't believe wasps swarm around a tree with no blossoms and no fruit for weeks at a time. There has to be a nest. Any thoughts?

Are they wasps or yellow jackets?

I know for a fact that yellow jackets will make nests in the ground as I have discovered these by "accident" a couple of times. Not sure about wasps however. Maybe you should just observe the base of the tree from a safe distance to see if this is the case.
