I was in the mall and a tmobile rep called my daughter and i over asking what cell plan we had. my daughter tells him sprint he then tells us he can give us a cheaper plan and new phones etc. i told him i have a contract w sprint of course he tells me he can get me out of the contract. he wants to do a credit check i told him it won't go through as i had to file bankruptcy last november. so he says he can open a account for me but do credit check on my husband. this is all done without my husbands consent. he even takes my husbands credit card and opens account. i go home and panic and call sprint and go back to sprint. then i go to return the phones to him and he says you have a better deal w us etc. does he have the power to get me out of my contract w sprint? what about the credit card charges not authorized by my husband? help please.

  1. You have 30 days to return the phone point blank, all cell phone carriers abide by this rule, so you arent in any trouble.  Take the phones back make sure they're in the boxes and just tell them you changed your mind.  They might give you some c**p and try to get you to keep the phone because they do get paid by commission, they dont care about you or what is best for you.  Also if they try to give you any c**p, it is illegal for them to even Sell you the phones under your husbands name being that he wasnt there to sign the contract.  So either way you are not stuck, Do some research next time and dont let sales people take advantage of you because they will! And do not go with Tmobile, they suck.  If you want to change providers try verizon or at&t.  Good Luck =)

  2. Why did your husband give him his credit card if he did not want charges on it?  You have to realize that the people in the mall work mostly on commission so they will try and force you to purchase stuff. If you do give them your credit card you are liable for it.  I would always recommend keeping your money and credit cards in your pocket and just keep walking next time.  I do not know if they can get you out of your contract, I would call Sprint back and ask them if T-Mobile got in contacted them about ending your contract. Did you actually get a new phone from T-Mobile then?  If you did you always have 30 days to take back phones and end your contract if you are not satisfied. All mobile phone providers have this. I hope this helps! Good Luck!
