Am I obligated to pay a Realtor commission if not licenced in the state?

I have a flat fee MLS listing true a broker that does not represent me but lists my property on the Local MLS.

The listing agreement states I pay commission to a Byers broker if he is represented .

Now if the buyers broker is not represented I pay no commission.

If the buyers broker/Realtor is not licensed in Nevada where the commercial property is located and I reside an I obligated to pay his commission?

  1. That’s not even a factor. If the “agent” isn’t licensed, he can’t have anything to do with the transaction unless he’s buying the property himself. You can’t practice real estate in any US state I know of without being licensed in said state.

What does your listing agreement state?  That will be the guiding document, along with your particular State's laws regarding the matter.  Some states allow this.  For instance, property is in Nevada and buyer and buyer's agent are from Texas.  Buyer's agent advises the buyer about your property and all negotiations take place while in Texas, the buyer's agent can be paid a commission, but he/she would have to ensure they get paid by separate agreement with you or the flat fee broker.

  3. Probably not.  Call Nevada Division of Real Estate, and they can give you the answer.

    My guess is that anyone selling real estate in Nevada (unless the real estate is their own)  without a license is going to get a fairly stern slap on the wrist.
