Am I parked on sidewalk or not?

I got a ticket for parking on sidewalk, but I want to find out am I really parked on sidewalk or on part of the house property.

My landlord told me the space in front of the house (a tilted downhill pavement extended from the garage and the front wall of the house) is okay to park since it was part of their property. So I parked on the tilted pavement, where I only blocked the front door of the house, which is fine with landlord. And there are still space left for people to walk. From the end of the pavement to the curb there are roughly around 5-6 feet of space.

Also, correct me if I'm wrong, because my freinds say there are certain amount of spaces in front of the house are still part of the hosue porperty. So I wondered if the space I parked on is considered as part of the sidewalk or part of the house property? If it's on house property, can I appeal for dismissal of the ticket?

  1. FIGHT IT.

    Get a signed letter from the landlord telling you that he advised you it was OK to park there.  You took the right steps to get permission to park there and assumed that, with the landlord as property owner, you were allowed to park there.

    Technically, however, the city/town owns a section of land away from the road, which landowners have to accept.

    Explain that you didn't understand that and obviously neither did your landlord, but you know now.  Ask the judge to dismiss your ticket because you can't afford it, and now that you know better you are not doing that any more.

    Unless he or she is a total ****WAD, they should let you go.

    Get that letter though, or they probably wouldn't believe you.

  4. In all states you would be ticketed for doing this because that property in reality belongs to the city, it is called the "easement" and you cannot park on it....

  5. It never hurts to ask. Tell the judge what your landlord said.
