Am I responsible for husbands debts?

If my husband goes bankrupt am I responsible for any of his debts - my name is not on any of them as being a signatory or a guarantor.

  1. well for richer or poorer, let him know he F**ked up big time help out with a 1/4 of it not all of it he has to pay it off himself!


  2. This is going to depend entirely on the laws in the state where you live. In common property states, the debts become shared responsibility as soon as the marriage is legal, regardless of whose name is on the paperwork. Some states may make exceptions for debts incurred before the marriage.

    You will be best off getting your own lawyer to represent you if he has to go to court. He may go after your assets, even those you received before marriage, like any inheritances or trusts that are solely in your name.

  4. if your husband has to file for bankruptcy and you are still married you have to file to....i know it sucks but its federal law...i had no idea of my husbands financial trouble until after we were married mine was good, his was not i had no debt at all except for a few medical bills, we had to file for bankruptcy and i had to file to, no way around it at all

  5. no! he should get himself out of trouble if he got himself into it. if your name isn't on anything, you should be right and you don't legally have to help him.
