Am I responsible for my fall?

I slipped and fell on ice yesterday morning at 5"30 AM

I was on my way to my car in the parking lot that is outside the door where I live in a Public housing building for seniors and handicapped people.

There was an icy patch that I did not see and fell.

Is the property owners responsible or me?

  1. It is unreasonable to expect property owners to be able to keep all the property free and clear of ice in winter conditions.     They would most likely be responsible if you could prove they were taking an action, or lack of attempt,  that purposefully causes a hazard,  but ice in the winter is expected by most people.    Holding the property owners responsible is like holding a state responsible because the road is icy.

    Sometimes we have to take responsibility for our own actions and safety.    Slipping is unfortunate,  I hope you have no serious injury.


  2. it is impossible for owners to keep ice off 24/7 and at that time of day it's likely on you since it is before business hours

  3. Do you think hot coffe you buy should have be careful HOT written on it? Use common sense. Always be careful for the unseen.

  4. it is the property owners responsibility to remove snow and put down ice melt for the icy patches.

  5. a big problem in todays world, everyone is looking for some one to be held responsible for their own misfortune. Its cold out then there might be ice somewhere, LOK FOR IT & EXPECT IT!!!!!!!!!! Quit blaming people for your own stupidity.

  6. I hope that you are ok. I would report it only if you have sustained injuries. Perhaps talk with an officer and see just where you stand with this. Personally, I would think that they would be responsible. It is there property after all. A home owner is responsible for anybody being injured on there property, even if the person was not invited on your land! They should have the area salted well, so that someone does not get seriously hurt in the future. All my best to you.

  7. Yes u are responsible for the fall. It's considered an act of god or act of nature. Nobody physically put the ice there and even with salt it's possible to fall. It's like when u go to walmart and fall in there parking lot there not resposible. Or when ur car spins out of control on a blk sheet of ice. You cant sue the town, that type of thing.

    The place should have an incident report form tho, where if u did seek medical attention within 24 hours it will go to there main bosses and they could possibly decide to side with u.
