Am i considered illegal?

i came here when i was 3..under my mom's passport since im her daughter. we renewed my passport from my country and it wont expire till next year. also, i recently married and my husband is an american citizen and were having a baby. so what can i do in order to get a social security and work permit so i can work after the baby? they keep asking me about my status, and i have nooo idea about immigration n all. and i dont no my parent's status either...dont know much about them actually n i dont have a place to reach them. n e advice?

    You were not a citizen before, but what I believe they call a resident alien because you had a valid passport from your country.  Now that you are married to and pregnant by an American citizen, you can apply for US or dual citizenship, depending on your preference.

  5. Your child can not be deported, because he or she will be a citizen by birth. You unfortunately can, unless you mother filed the necessary paperwork. Like they have been trying to do with this Mexican woman in Chicago who has an American little son.

  6. You are not a citizen. Unless you have taken the time to study and pass the citizenship exam, you never will be either. If you came to the US on your mother's visa that is no longer valid since you now are married. You will need to apply for resident status to get a green card. Most likely since you have never applied for that green card and have been living under the radar, the SSA card will have a no work restriction until your legal status is clarified.

    You will first have to report to immigration, surrender your passport, and apply for legal residency status under your own name, not your parents. Take your school transcripts to show you you attended school and graduated. Yes, graduated. It will help prove that you continuously have lived in the US since you were 3 years of age. Any time out of the country starts the clock all over. case in point Craig Ferguson recently became a citizen. He had to go to Canada or Mexico every so often as terms of the visa he had. That started the clock over until he got the green card. he has only been a resident for a bit over 7 yrs, even though he has been since the early 90's.

    Get the INS matter taken care of first. Until you have the appropriate visa or Green card, anyone who hires you will be subject to a $1000 fine @ per day for every day you work for them. Any SSA card you get until will be for document purposes only. It will be illegal for you to work under it.

  7. If your parents were here legally they would have had visas, but no visa last for more than a few years without being renewed. Going on what you are saying before you got married to a US citizen your status was illgeal. You would had had a current visa stamped in your passport. So my guess is that at that point you were all illegal.  As you state you have 'no idea of your status'

    As you have got married you will be able to get your husband to help change your status but as you have been ilegal I am assuming for many years it is going to be hard to make you legal.

    If you parents wait (your comment) and your visa has expired then you are out of luck you are not in status. If your parents has a work permit it has a date on it, and it will say when it expires, being on a work permit means they have a visa. A work permit only last up to three years, most are 12 months before they have to be renewed. So either your parents are illegal and their work permit has expired, if they have not put in their paperwork either.  And I asusme from your statements that you know that. Any good lawyer would tell you you have to keep your legal status current at all times in the USA.

  9. Marriage and/or a baby will not protect you from being deported. You will likely have to return to your home country to apply or face a 10 year ban if you are caught here illegally.

Hello First you need to go to the Governments Web Page :  www.uscis.gov they can help you answer all the questions free no charge they have an 1800 number were you can call .I would give them only general info and not give specifics with out talking to a lawyer first.  If you email me I can try to get a phone number for a lawyer that comes out in a Latino Program wich charges 0.00 to answer questions.
