Am i entitled to holidays if i been on the sick for 4myhs?

i have been on the sick for 4mths as i broke all my fingers.I have just returned back to work and my employers have told me i have no holiday as i have to accumulate my holiday.I m not sure if this is right any suggestions

  2. In the Uk the law is that holidays are no longer accumulative.  Now an employee can take holiday , if approved, within days of starting a new job.  Years ago an employee had to work 6 months before any holiday could be granted.  

    No matter how long you have been ill from work in any one financial year (April to April) you are still entitled to the same amount of paid holiday.

    your contract  should state how many holidays you're entitled to and there should also be something which states when you can take them.  

    I think what your employer has said is that they cannot grant your holiday date requested .  You might have to honour that now, but make sure that you can take your full holiday entitlement this year.

    if you were to leave that job, they would have to pay you holiday money accumulated for the months you have worked there, so you HAVE actually accumulated paid time off.  If you had taken more holiday in one year than had been accumulated and then left the job, then that paid holiday not due would be deducted from your final wage packet.  What i mean above is that nowadays an employee can take all their holiday (if approved by the employer) right at the beginning of the year, without having worked anytime at all - it's just that they would not be entitled to any more that year, and if they left a month later, then the money for holidays paid would be owed back to the company.

  3. You accumulate a day & 1/3 holiday (I think this is the ratio) for every month you work.  You don't accumulate holidays while off sick.  If you are in the UK check with ACAS. www.acas.co.uk

  4. you should still have holidays as when you were off you should of been on sick leave not on holidays!

  5. ask for a copy of your contract and check
