I am working in a real estate in dubai uae under unlimited contract . I am working here for about a year now. I got a better offer in Dubai Knowledge Village which is a freezone. I file a resignation but my boss refused to sign it. He treatened me that I will be ban in UAE for 1 Year and I need to pay all the expenses for my visa. I have many questions I hope somebody can help me to get an answer.

1.Can I still resign and join the freezone company?

2.Am I really get a 1 yr ban in UAE?

3.D o I still need to pay the expenses for my visa?

4. Am I still going to exit the UAE after the cancellation of my visa, even I got already an employer from freezone who will give me a freezone visa?

    Due to the fact that your labour contract is for an unlimited period and if you have completed the minimum period of service which is one continuous year, fixed by the labour law - then in this case you can give a month's notice, in accordance with Article No. 117 of the UAE Labour Law which considers such a period of notice obligatory for both the employee and the employer.

    As for the issue of visa transfer and whether the sponsor has the right to refuse an NOC or not, then I would actually say that the Ministry of Labour grants the sponsor the right whether to grant the employee such a certificate.

    Regarding question no 4: As per the labour law, the Ministry of Labour will apply a ban for six months which is automatic, upon any cancellation, without the demand of the sponsor.

    THIS BAN WILL NOT EFFECT WORKING AT A FREEZONE! But you need a  NOC from your present employer. Here you have to find an amicable solution.

    The Ministry of Labour usually asks the sponsor about an NOC letter regardless as to how long the employee has worked for the company.
