Amended Return, Still haven't received tax refund??

I filed my 2007 taxes early 2008, filing single. Well my boyfriend and I have lived together for around 3 years. When he filed his taxes, he filed us jointly for common law marriage(we live in Alabama). I sent in Form 1040X to Amend my filing status. We mailed out the forms on April 14th and still have not received our refund or our stimulus. We have called them already about a 2 months ago and they said that they will send us a letter if something is wrong. They still haven't sent us anything. It is weird that this is happening because we already received a refund from the state, now we are just waiting for the federal refund. So our filing status must have been accepted.....The "Where's my Refund?" link on the IRS website still says that it is delayed. Is the amended return making it delayed?? I am wondering if I should give them another call? It has been 4 months since we filed. What should I do?

  1. While the IRS says it takes 8 to 12 weeks to process an amended return, it usually takes nearer to 6 months.  Since you have waited the time the IRS has told you and you have not received the letter, I would contact the Taxpayer Advocate Service.  Visit the IRS web site at www.irs.gov and near the bottom of the page on the left side is a the Taxpayer Advcate Service.  This is a free service and they will help you expedite the processing of your amended return by the IRS.


  2. The delay is due to the huge volume of amended and duplicate returns due to the economic stimulus payments. Incidentally, the way in which you did this doesn't help matters. Your common law husband should not have filed a separate return. This caused a duplicate filing situation because your SSN and name are on two different returns. You should have simply amended your return to include him, although that would have denied him of his stimulus payment. Filing your own amendment when he filed a joint return as well only compounds the problem.

    If you filed as single and your boyfriend/husband wanted to file as MFJ, the two of you should have amended YOUR separate return into the MFJ one.

    By filing a new MFJ return and an amended one for you (what the dickens did you put in column C, all zeroes?), you created a duplicate return situation.  These take forever to untangle.

Call IRS at 1-800-829-1040; but IRS is behind in processing amended tax returns, and since you file a return and then your partner filed joint, you two cause a big problem so IRS must investigate your returns.  You should have waited until IRS send you two a letter about the original tax return and then the problem would have been resolved.

    call IRS but be patient you will have to be on hold for a while.


  5. Call them and  stay on the line until you get  answers to your questions. They delayed mine it took several calls to find out why. Have all of your information handy-SS#, F. status, etc.- when you call.
