I am a single independent student who was unlawfully claimed by another tax payer as a dependent. Upon notification of this, I filed an amended return and recieved the other portion of my tax refund. I was supposed to recieve my economic stimulus check on June 20th but after checking the status of it on the IRS website, I have learned that I will not be recieve my stimulus check due to me being claimed as someone's dependent. My question is, what is the best route to take for my situation? Is the delay due to me filing an ammended return?

  1. amended returns has no effect on the eligibility for the rebate it's based on the original return filed, but there will be a 2nd chance to qualify for it if you didn't qualify for it this year,if you qualify for it next year in 2009 when you file taxes you can claim it then.

  2. It's not a matter of a delay.  If you didn't claim yourself on your original return, you aren't eligible.  There are only a very few items where an amendment affects your eligibility, and amending your return to claim yourself isn't one of those items..

If you make enough next year to owe taxes, you'll get a tax reduction next year due to the stimulus law.

  3. Next time you discover that your efiled return is being rejected due to someone else's error, MAIL it in.

Your decision to efile *anyway* and then amend to add your exemption back is what caused the problem.  Had you mailed your return in, your original return would have gotten you the early rebate.  Now you will have to wait for the 2nd chance worksheet on the 2008 tax return.
