    D.  affirmative action causes a very mixed reaction from people.  

    D Unfortunately, there is still a great deal of gender discrimination, as witnessed in the primaries this year.  Hillary won the primary vote, the powers that be gave it to Obama anyway.

  3. 1:  B.  While we have historically discriminated against almost all immigrants at one time or another, immigration was and is a nation of immigrants.

    2:  D.  Look no further than the split decisions in 2003 regarding a)  Undergraduate Admissions at U. Michigan and b) U. Michigan Law School.  The court found a problematic and b acceptable, with the upshot being that awarding "points" for racial groups is unacceptable, but diversity is a legitimate criteria as part of a "whollistic" admissions process.  Some on even the current court would allow more thorough AA, while others find all AA inconsistent with the 14th Amendment.

    3:  B.  While statistics regarding women in the workplace are widely quoted to demonstrate continued inequality, the fact remains that the majority of undergraduate and professional students at most major universities are now female.  Statistics regarding comparative earning power fail to account for several factors including, but not limited, to the following:  a) gender attitudes regarding the relative importance of career amongst other goals, b) life choices, c) intangibles beyond length of employment and job title (such as hours and effort), and d) the disparity in fields and job choice.  While inequality in absolute comparisons remain, equality amongst apple to apple comparisons is apparent, and if anything, favors women in employment as employers find themselves seeking talented and motivated women to work for them (as female retention rates are astonishingly low).
