American marrying Brit in the US?

My partner is from the UK, I am an American citizen. We are wanting to get married here in the US, as it is much easier than the UK, but not settle here. We would return to the UK and settle there when allowed after we are married. Question being........can my partner simply enter the US on his visitor visa, and go to a courthouse and get married, since he/we are not planning on residing here in the states? I've heard many conflicting answers, some have told me personally that he may simply enter on his visitors visa and we get married, it's only complicated if he wants to stay and work here, others say he must have fiance visa? Anyone know anything about this? Thanks so much:)

  1. there is no absolute answer as it is a pretty hard question...

    i would think that the best think to do is for you to get a british fiance visa and go marry him at the uk...

Yes he can enter the country on his visitor visa and get married, the problem that arises when people do that is when they try to adjust status to a permanent resident from a visitor visa as immigration considers that to br visa fraud. This is why people say you must have a fiance visa. However, if  you are not going to apply to adjust status here then there shouldn't be a problem, to my knowledge you don't have to provide proof of your immigration status in the USA to get married.  You might want to consult an immigration attorney just to make sure though.

  3. If his intentions are to get marry to you and for both of you to go and live in England.  I do not see the problem, but to the eyes of the officers at the airport, it might appear that he might stay here an immigrate.  He can adjust status if he has a tourist visa, but if he will be coming into the U.S. under the visa waiver program, he can not.

    If he tells the officers that he is going to get married, his entry into the U.S. might get denied and he will be return.

    In my opinion if both of you are planning to reside in England, just get marry over there.
