I need help....

I need to know whether or not Amtrak keeps passenger lists in respect to people who actually boarded the trains.

If anyone knows that would be extremely helpful.

Thank You.

  1. Only Law Enforcement can have access to those file. They do not allow the general public to know whether someone is on one of our services or not.  Next just because there is a list, does not meen they travel.  A passenger can book the travel segment, purchase the ticket, but never board the train.  They do not know whose tickets was "pulled" until the trip is over and the conductors trip pouch is turned in.

  2. Are you checking to see if someone was telling the truth, or pre-planning to prevent anyone else from checking?

You might try Amtrak Police.   I couldn't find a departmental site, but this is the official site of their FOP lodge.

Someone there must be able to answer your question for you, though you should be prepared to hear the words "subpoena" or "court order."

    ** edit **

Is this missing person, as in possible abudction, or simple runaway?  You might want to contact the FBI office in Philadelphia  (215) 418-4000 and run this by someone, being that it now involves two different States.   The FBI does investigate kidnappings, though I am not sure about runaways, adult or juvenile.

Have you requested the Philly PD involve the FBI?  If not, you may want to make a formal request to that effect, in writing.    If the PD is unable/unwilling to request a Court order for the passenger list, then the FBI may be able to do more for you.  I really can't remember if the FBI can simply involve themselves, or if they must be invited by the investigating agency, so that will be one of the first questions you should ask.  I do, however, remember reading that Amtrak and the FBI share jurisdiction in investigating rail-borne incidents.  When you call, be prepared to provide the agent with the incident particulars, including the name, as well as the name and contact number of the Philadelphia PD investigator and a case number, if known.  They will certainly check the validity of the investigation before anything else.

If they do become involved, I believe you'll find them unhampered by the red tape and interagency non-cooperation you've seen so far.

Of course, you may also want to contact an attorney and see about having a private request made in the mean time, not knowing how long these records are kept.  Instruct the attorney to include, in his affidavit, the conflicting information and non-cooperation thus far.  The judge may be more apt to issue the order, knowing that you've exhausted all other options.

Another option may be to send a registered letter to the office of the Chief of Amtrak Police, advising him of the contradictory reports and asking that his office remedy the situation, while re-requesting the original information.  It would be best if the Philly investigator sent this on letterhead, of course, but if they are unwilling you will again want to provide the particulars and investigator's contact information.

I realize this all sounds adversarial, but the priority is locating the individual, and if they're not willing to do the job then you mustn't be afraid to force them to do it.
