Any Insurance Adjusters out their ???

I have been backed into at a stop light,he caused enough damage to dent my front bumper and jam my wrist into the steering wheel(caused a sprain and gangillion cyst)...I have an orthopaedic who wants to take out the gangillion cyst caused by the accident(which pains me,being I am in data entry field) what can I say to get them to pay for my surgery ? *($900) for surgery I have *($500) in lost wages from doctors appts,and saw my chiropractor for 6 wks (chiro has been paid already) ,I have paid my co-pays*($150) for ortho doctor,and if i have the surgery ..I will be in a cast for two weeks ,and I'll lose *($1000)

in lost wages being off work.

What can I say to get them to pay for my surgery ?

How much is my case worth,when adding up the numbers?

and please add the amount of for emotional distress I should ask for ?

cause I am so scared to have surgery!

    Ganglion cysts are caused from overuse of a joint. Which, you being in the data entry field, makes perfect sense. You did that to yourself. Your sprain may have been caused by the accident, but that's a self-healing injury.

    How do you get them to pay for your surgery? Easy, go get in an accident that causes you actual injuries. Not using injuries that you would have gotten anyway, as an excuse.

    And no, you don't get emotional distress.  None of that was emotional hardship. You used the wrong hand position while typing, caused yourself a cyst, and are now paying for it. No one should pay you a thing for that.

    As a final note, seeing as you wanted to go after a store for your son falling on a wet floor, which was just an accident.....seems like all you want to do in life is sue everyone you can. Quit looking for a lottery through other people.

    Oh, and from a mechanic's point of view:

    1.If someone in front of you had the opportunity to back into you, it means you weren't paying attention. Or chose not to move.

    2. There's simply no way that they were moving with such great speed, that it would cause you to be violently thrown around in your car. The fact that you only got a dent in your bumper, proves this. I'd imagine the driver's speed was less than 3 mph.

    3. Based on thousands of crash test examples, if you were backed into, it would have brought your body down and forward SLIGHTLY, then backwards. Which means you are moving AWAY from your steering wheel, not towards it. That's basic physics. But considering the insignificant speed, there's no reason to believe that injury was possible.

    Unless you saw the vehicle backing up. Decided not to move, and when hit, you threw yourself around, knowing that you would get money out of it. And if that's the case, then you deserve every bit of "pain and suffering" you receive.
