I'm a tenant in a commercial building, the landlord brought a roofer to replace the whole roof, this people riped the whole roof in the middle of job they left unfinished roof and gone, because, land lord didn't pay the roofers, there was no way for us to know or to see how bad was up there, very high ceiling look, on the second day we had lots of rain, our equipment got water damaged, we could not find the roofer, I went true to my own insurance and got paid to my limit, but the damages are far more, I went to the landlords insurance, no chance, since in the lease hi is protected of such damages, I hired a private investigator and found the roofer, no help from my landlord, he says I don't have insurance for content, can I go after the roofers insurance ? and what is my chances? what is the correct way to pursue this matter, I called my insurance to let them know I found the roofer, the said they will call it act of God and close the claim, I don't want to hire a lawyer at this time, Please advise if you are in the field and know my answer

  1. First off, there is no act of God exclusion. So for them to close the claim because it was an act of God is pure B.S.

    That being said, the fact that remains is your insurance company has paid the policy limit which was the amount of insurance you chose to purchase.

    You chose to purchase an inadequate amount of insurance. Why should it be up to the insurance company to pursue your claim after it has completed its obligation to pay for the coverage you purchased?
