Any idea how much i will get off a Settlement from a injury from a car accident ?

I was involved in a car accident june 21st 2008 this year.. i was driving down the street and when a suddenlywithout hesitation a car reversed out of a parking lot at rapid speed and hight the front right corner of my car.. Damages: Hood, Right Fender,Right Headlight, Front Bumper Lip, Engine Bay Framing, and Front Tie Rod ends..

Totally could not drive it home i own a mitsubishi lancer oz rally

so today they told me that the other guys insurance is going to pay for my damages to the car .. so i went to the body shop to sign off on the papers that say that body shop is going to make repairs to my vehicle..

i didnt go to the hospital but i am going to pain management therapy and i just did a MRI .Neck Back Lower Back , Shoulders and Right arm.

Hurting ever since the accident..

I have no points on my license .. i had never had a car accident this is my first and only accident i had.

Any Idea of what amount i should expect to get .. the lawyer will be taking a 3rd of my settlement..

is $35,000 a reasonable amount to consider?

    Sorry about that but you aren't going to get anything NEAR that figure, pal. i don't know what the h**l your 'lawyer' has been telling you but will be lucky to even get 1/3 of the amount you spent on your so-called 'pain management' therapy. Why don't you just tell us what really happened -- your 'lawyer' (the scum) sent you to a chiropractor in hopes of making a nothing claim into something. Well here's some news: the insurance company has DOZENS of lawyers and they are not afraid of yours and they are certainly not afraid to go to court. Dude, this could drag out for months and months and when it's all over the only person that's going to get anything is your vermin lawyer.


  2. I'm courious to know the dollar amount of dmages to your vehicle.  If you were in sooo much pain then why not go to the ER?  

    It appears from your description that this is a soft tissue injury.  the insurance company will make a decision based on medical bills, lost wages, what kind of damage you had, your age, physical condition, activity all that comes in play.  once a settlement is given your attorney will start negotiations.  

    Being this appears to be soft tissue, and I say this or else you would h have been seing specialist, I wouldn't expect too much.  Especially 35,0000.  a claim for $35,000 would be a fairly serious claim, ie broken femur, broken pelvis, hospitalzation, permanent lifetime scarring and such.  from what i can see, this will not be the case.  and on top of this 30% goes to your attorney BEFORE bills  are paid.  

    The old addage that you will get 2-3 times your medicals is severely out dated.  


  3. I'm sorry to tell you this bro but his insurance will fight it til the end. They will say that if you were really in pain you would've went to the hospital. I'm in the exact same situation. Still fight for it. You may come out better.

It all depends on the damages, your injuries, loss of income, if any...when ever you are in an accident, its always better to go to the hospital regardless of whether you feel any pain or not...because you may feel it later and at least you have a record and an ER report...also you should always get a police report as well as witnesses, if any....pictures are also good to have....the more extensive the injuries, the more you can get.....especially if there is long term damage, and an inability to work or surgery is involved. Medical bills and out of pocket expenses are also considered. So keep track of any co- payments or expenses you may have incurred as a result of this accident.  Has this accident really affected you dramatically, has your quality of life been changed?  What is the measure of your pain and suffering? All of these things determine the amount of settlement you could receive which would probably be more than what they are trying to offer you now.  The reason they want to settle is because it becomes more expensive for them when a case is taken to trial....the other guy's insurance company is trying to avoid the cost of legal proceedings which would require hiring an investigator, court fees, attorney fees, paying to obtain medical records, vendor bills, etc. you would also have to appear for a deposition and your account of the accident would be taken by counsel for the insurance company....every thing is looked at....a value is attached to the case and both sides would go back and forth with regard to a reasonable settlement...if no agreement is reached, the case could go to trial and a jury would be presented with all of the information. Your testimony would be required again, as well as the other guys testimony, then they would determine how much you should receive.  

    While I am not an attorney, I have worked in the trial division of an insurance company for 9 years. These cases often become a long drawn out process that could last for years so ask yourself this question.....would you prefer to drag it out for a larger settlement, if possible, or would you prefer to take the $35,000 now minus your attorney's cut.  If the physical therapy, medical expenses, loss of wages as well as pain and suffering far exceeds $35,000 then you should consider persuing the case, if it does not, then take the settlement.

  6. Sounds like your injury is a sprain/strain type injury.

    Usually these injuries do not settle for anywhere near 35K.

    The lawyers fee is not the insurance companies concern. They do not pay more on the settlement so you can pocket more. The lawyer's fee has no bearing on how much the insurance company will pay. The adjuster does not care that YOU chose to give 1/3 of your settlement to a lawyer.

    The settlement will be based on the injury itself. If you decided to hire a lawyer and give him 1/3 -- that's your choice and your responsibility to  pay him.
