Question:

Any insight as to how to handle an MIP, and is deferred adjudication a good idea?

Ironically, this 19 year old, truly wasn't in the house of the party, he was outside, and had never been in, was waiting for a friend, but the cops made him go into the house, and gave him ticket for minor in possession of alcohol. Do you pay the ticket and get it over with, even though not guilty, do you choose the deferred adjudication, and have to do comm.service,(pleading no contest), and eventually get to have it expunged from records at 21,if you appeal, But, if you do something wrong in the 6 months, you get "found guilty" posted on the original ticket, anyway. AM I understanding all this, and what would just paying it in the first place do to your car ins. rates, and life ambitions?

  1. Without going into why the Police would send a minor into a house and then ticket him for MIP, I will address the basic question only.

If you feel you cannot win this in a court of law, my best advice would be to take the the deferred adjudication. Do the community service, keep your nose clean and when you turn 21, your record can be clean again, You have no idea of how many doors this will keep open for you as an adult later in life in not having something like this hanging over your head,

Best of luck and I hope this is useful to you
