Any on line resources for special ed law?

I've been teaching special education in Hawaii for 6 years and have been out of school for 10. My school does some things that I would consider to be questionable but before I call them on it I'd like to make sure that I'm correct. Are there any reliable online sources regarding speical ed law? Specifically there is a teacher who is refusing to take a kid into her room because she thinks that she has too many kids (4) and wants to put him in regular ed because of this. (I know, I can't believe it either!)

  1. Well I believe it. You will learn that schools are VERY corrupt when it comes to special ed all over the USA.

    THere is a LOT of information, a LOT to learn, it can be overwhelming. But there are lots of groups to help you.

    A very good one is a yahoo group called  'IEP something'  Just put IEP in the search box on yahoo groups.

    If this child has an IEP plan and is suppose to go into this teachers room, then he HAS to go in this room. She is violating sped law IDEA which is a federal violation.


  2. In Hawaii, you'll want to contact your District Education Specialist (DES) about that. You can find the one for your complex in the state directory. They should have the 08 edition in your office if you don't have one in your classroom. If your school has gotten a bunch of new IEPs lately, or if you've gotten a few with intensive minutes, you'll want to ask your DES about the possibility of adding new staff.

    Chapter 56 is online, though it will soon be replaced by Chapter 60. You might check out wrightslaw, too, or you could let your DES sweat that one. Speaking of law, did you get to hear Art Cernosia speak this time around? I love the lawyers! They make it all sound so logical!
