Question:

Anybody how to go about adopting a kid that's already in our custody and her parents do nothing for her?

she was already taken away by the state 6 years ago. and her real parents are just parasites to society

  1. If she has been taken away by the state 6 years ago, is she in foster care?  I agree with the first answer here.  But I'm concerned if she was taken away from the biological parents so long ago and it doesn't sound like any formal plans have been made - are you here foster parents?  If so, talk to the state and see how they can help you with the adoption.

  2. If she has been in foster care for 15 out of the past 24 months then federal law says the state should be acting to terminate the parental rights.     Can you ask the caseworker if than is in the works?    If not what about the childs GAL or CASA  volunteer.    

    You need to keep your opinions of her parents out of it!   That won't reflect well on you.

  3. my lady friend is the sister of the mother but they had to go to court to have the rights to the kids.

  4. She's been in the system 6 years??  Someone has fallen down on the job. Rights should have been terminated years ago. Professor C is right.  Contact the GAL for the child and get a CASA worker movin on this.

  5. i totally understand where your coming from, my brothers and ex-wife's 2 yngst live w/me, they have been in my custody and under my care for the past 3 years, neither one of the parents have done anything to provide or even send money for there school uniforms or there well being............when it comes to the fact of the matter issue, the parents still have legal rights, and at any given time the parents can come in and take the child away.........irregardless of the fact...........

    i would suggest that you get a lawyer for starters, since they've been in foster care there is a really big possiblility a judge my grant you temporary custody of the child, once the judge/case worker sees that the original parents are dead-beats, then you may get full custody.

    but really hate to say it man, it'll be a long and hard battle, if these peeps are anything like my bro and sis-n-law they'll do what they can to make themselves look good.

    a lil fyi you can go to wel-fare or even cps and get them to force the parent[s] to pay child support, provided they or even one of them are working.

  7. I am in total agreement with your first answer about contacting your case worker and keeping personal feeling about bio parents out of it.
