Anyone have an example of a petition for my DUI case?

Pops was arrested for dui but was never driving a vehicle. Now he wants a peition for him and his witnesses to sign that he was never drivnig under the influence. He had a designated driver. Anyone have a good example I could see to get an idea of what to look for. Thank you so much.

"My name is _______.  I am over 18 years old and fully competent to make this affidavit as I have personal knowledge of the facts contained herein.  I was present when ________ was arrested on __________ for Driving Under the Influence.  The truth is that _________ never drove any vehicle that day/evening.  Another person, ___________, was the actual driver of the vehicle that evening when it collided with the other vehicle.  I swear and affirm that this statement is true and correct.

Get it notarized.  Now, the problem is that the witnesses must be present to testify in court at the trial--affidavits aren't good enough.  However the attorney could present them ahead of time to try to convince the prosecutor to drop the charge.

Was he sitting in the drivers set? have the keys in his possession? riding a lawn tracker? more detail would help to find you a petition for dismiss
