Anyone know about Sale of Goods law.....

and my rights in taking back a two year old telly to Currys thats faulty (no sound). Manufacturers warranty was one year, did not take out extended warranty but feel an LCD tv should last more than 23 months. From reading through the 1979 Sale of Goods act (amended 1994) it states goods must be fit for purpose for a reasonable length of time, I do not believe 2 years is a reasonable time for a £500 telly.

Really what I am wanting is the steps to take, I believe they are.

1) Speak to Currys to see what they are going to do about it.

2) If as I suspect is true nothing get an independent tv repairer to do a report on what the problem is.

3) Speak to Currys to get them to do the repair.

4) If Currys refuse get it fixed by independent.

5) Take Currys to small cames court to get reimbursed on court and repair fees.

You will be wasting your time: A court will decide that the £500 over two years is acceptable, you are better off finding a local specialist & having it repaired - It will probably be easy enough to get sorted for around £50, this would also be taken into account by a court in deciding any case. You'll be spending an inordinate amount of time & money in trying to get back a TV that will have cost you an average of £2 per month in repairs from new.

  3. Under the sale of goods to consumers regulations2002 you have the legal right to

    Choose repair, replacement, partial or full refund, or compensation if a fault appears withing 6 years (5 years in Scotland)and it is reasonable for goods to last that long.

    This is the law.

    As you rightly say an expensive item like a telly would be expected to last much longer than 2 years.

    Do not be fobbed off by Curry's which is what they will try to do.

    You could have an independant company do a report but give Curry's the chance to sort it out and remember the law is on your side.  

  4. Like many others I don't think you will win this one. It's a fact of life that sometimes electrical goods go phut. Curry's will argue that's why they offered you the extended guarantee. If I were you I would grin and bear it. Get it repaired, it's only the sound after all, and save yourself hassle. Like you I never buy extended guarantees on the principle that if you invest what you would have paid out in premiums over the years you can afford to replace or repair faulty equipment should the need arise. On average I've won handsomely, as I suspect, you have.

    As far as I know the goods are only guaranteed for a year under statute law.  However you can seek free advice from trading standards.

Under the sale of goods act you have upto 6 years to file a claim, the downside is that it's not that simple to prove you have a claim, you'd have to show Currys that there is a manufacturing fault in the TV which has just showed itself & that the goods should've lasted longer than 2 years & if I'd paid £500 for a telly I'd expect it to last 6 + years, if it was a well known brand name I certainly would expect it to last longer than 2 years. I suggest you write an official complaint to Currys head office mentioning your problems & further stating that you'll be getting an independant repairer to assess what the problem is & that if any manufacturing fault is found that you expect redress under the sale of goods act, if they still refuse to co-operate then contact a solicitor for advice & also report them to trading standards.

  7. I hope you have a 2 years to spare, that is atleast how long you will wait to get currys in the small claims court. I think you are chasing a lost cause.
