If the images were used without their permission, then of course they should SUE.  This is the largest event in the World, so Presidential Candidates should be held accountable for whether they choose to follow the law BEFORE THEY GET TO BECOME PRES.  Otherwise, how will the public know if the candidate is going to follow the rule of law once President.  This all begs the question:

If McCain (even unknowingly) signed off on the ad and later stated he was "proud" of it, then what does that say about how he would choose to run the country?  Does he think he is ABOVE THE LAW?
