Anyone who knows anything about the law and crimes?

Question

Ok. Let’s say there were these two girls who got caught stealing something at a drugstore. What is to happen to them? The cops searched them without reading them there rights, is that a problem?

One was walking out which had made the alarm go off, and the other one was with her but more behind her, she did not walk past the alarm thing.

Could the one who made it go off be in more trouble then the other one, if so how much?

They where never giving a ticket, just told that it was to be mailed to them in 30 days.

What happens after that?

What is there to come from this?

Both girls could be looking at charges for either 488PC: Petty Theft or 490.5 PC: Petty theft from a merchant (both are misdemeanors).  

If the second girl had stolen property on her then she will have the same charge as the first, there is no difference regardless of whether or not she passed the detectors.  Bypassing the checkout stand and going towards the front door showed her intent.  She only stopped due to the first girl setting off the detector.

Depending on the situation, technically they could have been charged with burglary which is a felony (since they were not taken to juvenile hall I'm assuming that did not happen).

Since neither girl was issued a citation and you state that the Officer said that they would receive something in the mail then the Officer will write a report and issue a citation "via complaint" which means the citation is mailed to their residence.  The report will go to the juvenile probation department where and they will have to go in front of a judge to face the charges.  A parent will also be required to go with them due to being a juvenile.  

If convicted they are looking at a fine and probation.

If they are convicted and they are caught stealing again then they can be charged with 666 PC: Petite Theft (also known as petty theft with a prior) which is a felony.

u only get read your rights if yur geting arrested not searched.

and the thing in the mail might not even come because cops r lazy and dont really like filling out the paper work.

but if it does you will have to pay.  if that person does not want to you will probably have to serve a certain amount of community service.

First of all.....Police Officers DO NOT have to read you your rights unless they are going to question you.   You were stopped by store security after the alarm went off and held until the police arrived.   They don't have to read you your rights to search you.  If you walk past the cash register and are heading towards the door and you had articles on you that you did not pay for.......you were stealing.  You don't have to be given a ticket at the time of arrest and they may not issue you one.  They will take this matter to the local district or prosecuting attorney and that person will make a decision on whether one or both of you should be charged with the theft.  At that time they may issue you a summons or they could issue a warrant for your arrest.  You will then be notified that a summons or warrant has been issued for you and you will be given a chance to appear in court on your own.  If you don't show, they will come find you and arrest you.  If this is your first offense, the Judge may be lenient on you and fine you and give you Probation.  If this is a subsequent offense, you could end up doing some jail time.  This offense will follow you and attempts to get a job that involves money or a certain amount of honestly will probably elude you for a period of time.  Again....pay for stuff, don't steal!

until your 18th birthday you have no rights. it sucks, but that's the way it is.

the one that got out of the store could be charged with petty theft, the other one attempted.

since they were not held and their parents called, i would say when the tickets come in the mail, i would say probably  a fine, and being banned from the store for a while.

i would suggest that they come clean to the parents before the mail arrives.

first they can search you ..second if they didnt give you any paper work with it and they didnt call ur parents to come get u they might just have been trying to scare u to not do it again ...but if it was on the up and up your probably going to get a ticket of 250 dollars and comunity service and you can go into that store for 2years or more
