Apartment Cleaned up tree damage to my car. Legal?

Storm blew through and limbs went everywhere. On my truck, through a cars windshield, etc. I got some pics at nite but left them there to take better pics in the morning. When I woke up the apartment had picked all the limbs off my truck and the ground! There is damage to my hood, window, and door! Did not inform me about any damage or anything! Can they be held responsible for neglect or something?

  1. Well, if the trees are on the land owned by your landlord, then you could possibly make a renters claim with their homeowners company.

    But, if the apartment complex does not own the trees and the limbs blew from elsewhere, sounds like you are SOL.

    If you have comprehensive coverage on your auto policy, you could make a claim for the damage. You would then be responsible to pay your deductible

You need to prove that they were negligent.  Was the tree diseased or dead?  If so, did they have adequate notice, and failed to remove the tree/limbs?   If not, it is doubtful you can prove that they were legally liable for the damage caused by the wind storm.  It does not matter that they removed the tree limbs from your car.  

    You will need to file a claim against your own comprehensive coverage.

  3. Not in Missouri -

    In Missouri it is very difficult to prove neglect.  It is your responsibility.  Even if the tree was on someone else's property.

  4. it is an act of god you will not get any where with the apt. complex try you insurance as a comp claim
