Question:

Apartment Retaliation?

My apt complex attempted an illegal eviction in July but I won that judgement. In the meantime, the apartment refuses to accept payments from me and has filed another eviction again. They provided me a notice to vacate and stated that my locks will be changed, however, they locked me out of the apartment the day they provided the notice. Then they placed another lock on the apartment AFTER they removed the first lock in the same rental period. They will not provide me a letter stating they placed another lock on the door. I have witness statements, but I am at the point where I want this to end. They will NOT take any payments in full. What can I do?

Also, my lease expired today. I turned in my 60 day notice to the complex, but they have "no record". The person I gave my letter to no longer works there.

  1. The police will let you in if you still have stuff in the apartment.  If they take you to court , you will win damages because of the illegal locks on your door.

It is time for you to be a homeowner.  No more renting for you.

  2. You probably have a very good court case, if you have the paperwork backing your allegations.

  3. Lets's see,. you are unhappy with conditions, you are not paying your rent and they want you out of there.

Why don't you just move?   The longer you wait the more court records will show up on your record making you look like the tenant from h**l and no one will want to rent to you.   You might not think you are a trouble maker, but for anyone looking at your credit report it will look like you are.

  4. I don't know of very many apartment complexes that will try to evict you as long as you are paying rent and not causing trouble....so I have a feeling we are not getting the full story from you.

If you won your judgment in July and they told you to leave anyway...that's 30 days.   They have that right.

However, they have to go through the court for another eviction.

If they changed the locks, the person you call is the police department who will inform them that they have to change the lock back, give you a key, or they will give you permission to break into the apartment.

You also need to start utilizing certified mail/signature required.
