Question:

Apartment taking forever to do repairs. When should i take legal action?

2 months after i moved into my apt i discovered that there were raccoons living in my attic, i could hear them scratching and even peeing. I told the apt front office about it and they said they would take care of it. It took them 3 almost 4 months to even send someone out to do anything. In the mean time the family of Coons tore up the duct work in our attic and chunks of insulation began blowing out into my entire apt. Not only that but even though my ac runs all day, my apt stays at a constant 86 degrees or higher all day long,( i live in FL). and my electric bill went up over $60 in one month. It has been 2 or 3 months since they got rid of the raccoons but have yet to do anything about the duct work. I was just wondering if there is any laws that they or breaking or if anyone knows the building and health codes for Florida so that i can take legal action if Neccessary. PLEASE HELP any suggestions are welcomed!

    you already "gave notice."

    so, you must hire the work done and pay for it and

    deduct it from your rent.

    Simple~

    Give the landlord a copy of the receipt that you pay

    when the duct work is repaired.

    do the same with any maintenace issues you have;

    notice first, then you hire it out.


  2. Kemperk was right on he money there. I would give him notice you intend to hire a person to repair the damages unless he gets it repaired prior to the schedualed repair you make.  

  3. First, you need to notify the landlord in writing about the problem.  Phone calls don't give you a paper trail.  At this point, indicate in the letter that 3 or 4 months went by before they did anything.  Insist that the ductwork and insulation be repaired.
