Applying for a K-1 visa from a country other than your home country?

My fiance would like to apply to the K-1 visa from Jordan (he is Palestinian and he studies in Jordan). I know that it is suggested to apply for visas from your home country but it is almost impossible for him to go to the American embassy in Jerusalem because of the checkpoints. Will there be less chances for him to obtain the visa if he applies from Jordan? Or does this not affect it?

  1. Apply for a visa at the US Embassy in Jordan as long as the requirements are complete.


  2. Because your fiance has demonstrable ties to Jordan, it could be possible for him to apply through the US Embassy Amman, but the decision is completely up to the Consular Section in Amman.  Contact them directly:

    Note:  While it is true that you will have to petition to USCIS for your fiance, even if your petition is approved, he will still have to apply for the visa itself, which can still be denied at the embassy.  Also, because documentation requirements can be more complex when dealing with the Middle East in general, and Palestinian issues in particular, it is in your best interest to contact the embassy in Amman personally - they are the only ones who can speak from a position of authority.

  3. if you are the US citizen, then you should be the one to apply for it. the non US citizen partner can never apply for it. you do all the petition paperworks in the US. if everything goes well, the processing is then forwarded to the country of residence.

    since your fiance is in jordan and is studying there... i'm assuming that he has legal papers to be there. if that's the case, then the government will forward his papers to the embassy/consulate in jordan.

    it will not affect his chances of getting the visa. it's dependent on you and him... not where he is right now. i'm a philippine citizen but a canadian permanent resident. was living in canada when my husband petitioned for my visa for the US. my papers were processed by the consulate in montreal.
