Applying for permanent residence in Canada as an independent high school student.?

You see.. My girlfriend lives in Australia, and she's going to move here (Canada), but, the problem is, we can't find a way to be able to get her to stay here as a Student (If you come as "student" you need to leave after your education is done), and she needs to continue her education (last year of highschool, and college/university). We need her to be a perminant resident, so she can stay here even after her schooling, and we can't find any way to make that possible.

If it's important information, she'll be living with me and my family.

Please, we need some help. I would appretiate any positive answers.

Please, don't tell me it's impossble for my beloved to stay here with me. : /

  1. She will not be able to come as an independent as she has not yet finished high school and therefore is NOT independent.  She will not be able to apply under family class as your family is not her family.

    Student visa (after she finishes HS) is the only option if she does not have any family in Canada.  After she finishes her schooling she will have to leave Canada per the visa---but you can then apply to sponsor her as your spouse, common law partner or conjugal partner.  Whichever suits your case.

    The ONLY other way that I can think of is if you are 18 years old then you could possibly sponsor her as your conjugal partner.  As the sponsor you must be able to show evidence of financial support to maintain her for 3-5 years as your dependent.  In order to show evidence of a conjugal relationship you must be able to prove the relationship is bona fide and explain the reasons why you have not been able to live together.

    All of these applications can take years to process.  

    I'm really sorry.  I know how it is to deal with immigration.  I had to live separately from my husband for almost 4 years while we dealt with immigration.  If your relationship is meant to last, it will no matter what the circumstances are.

You cannot sponsor her as she is not a member of the "family class".  However, if she goes to Canada on a student visa, and becomes your common-law partner, or you marry her, you can then put in an application for permanent residence based on humanitarian and compassionate circumstances.  Be warned, immigration Canada doesn't mess around and can smell a rat from a mile away, don't try anything stupid, 'cause you might just mess up her chances of ever returning to the country.
