Question:

Applying for title to home?

My husband and I purchased a new Redman home 5 years ago...we were very young (19 and 20) and were just so excited to be buying a home that apparently we assumed the place where we bought the home handled all the paperwork such as signing the TITLE to us. Well, I have just found out as of today when I tried to apply for a homestead exemption that our home was never titled to us. The dealership has gone out of business and I'm at a loss. Our mortgage company said that they can request the Note for our home. For some reason, and yes this is very stupid, but we don't have any paperwork or contract for our home. We have our insurance and city, school, property tax documents that have our name listed, but that's it. Now I'm trying to fill out a statement of ownership but it asks for the dealsership to sign, date, and notarize it and I don't know what to do...it asks if the home was moved to our property and for the name and sign. of who moved it...anyway, any advice? Thanks

  1. I'm assuming that the purchase needed to be handled by an escrow or title company, depending on what state you're in.  They are usually required to keep records.

Contact the company that handled your transaction and ask them for a copy of your file.  Expect that it could take a little time - a week or two.  Hopefully they have a complete enough file for you to piece things back together.

I'm assuming this is a manufactured home.  If it's permanently affixed you should be paying property taxes.  This would indicate that some sort of title work was filed somewhere.  If it's not affixed, then your info might be with the DMV.

  2. I think it would be best to contact a lawyer and immediately...
