Approval rate for Marriage Visa?

What is the approval rate for marriage visas? What are the major factors in paperwork being terminated? or visa's being denied? Also, if your wife has over stayed on the visa? Is it better she is here or she goes home?

Previous illegal activity is definitely a big reason for denial, including overstaying a visa. She should definitely go home BEFORE you apply..

Even if she does get denied, it looks like over half of denials for that reason get over turned anyways depending on how long she has overstayed. Though, if you get a denial you will probably have to involve an immigration lawyer.

Once she goes back, file the I-130 and take it from there..
