Hello pple,

Am new to this forum but find it quite helpful. Could any person advise me on what to do pls?

My hubby and I got married May 2005, he became an LPR August 2005 through the Visa Lottery, but I couldnt go with him then for reasons beyond our control.

In May 2006, he filed I-824 for me and that was approved August 2006, however on getting to the US embassy in my home country they refused to process it saying that his visa lottery year had ended. This clause is however not added as part of the conditions for "following-to-join" on the USCIS website.

We have since filed for I-130, but cant help thinking there might be a way round this refusal.

  1. Request your husband to file again for the lottery and apply again.


  2. Unlike all other immigrant visas, Diversity Visas are only available during the fiscal year the lottery winner won from the beginning of October through the end of September. At the end of that September, all elibility was lost. So, you would not be eligible for a diversity visa now based on your husband&#039;s 2005 winning selection.  Your husband could file a new immigrant visa petition for you, although that will take a long time, or you could enter the Diversity Visa Lottery yourself.

  3. You do not say where your home country is, so it is impossible to address your question completely.  Therefore, I would simply suggest that the website is not conclusive, and it would be mistake for you to act strictly on the information you obtained therein.  Your current course of action is best.
