Question:

Apt's sent me to collections with no notice?

Long story short, I checked my credit report last week only to find that my old apartments is listed under the collections section for about $300. I gave then my new address as well as did a change of address with the post office. I never got any form of notice or letters or anything from them for this. My question is, is there a law that they have to inform me about it before sending it to collections on my credit? These charges are wrong also, so I'm trying to get out of paying them if possible.

  1. they need to inform you BUT the landlord says "I sent you a letter'

    end of legal issues.

    Edit: ya right wait it out and so everyone else does and we end up in the great depression 2. You owe this, pay it


  2. If I were you I would contact the company (the original creditor) and go over with them the amount.  I would just pay this bill and wait awhile to dispute this entry off of your credit report.

  3. I would use that as a valid permissable purpose to delete the account with the creditor. I often fake billing statements to show creditors my clients didnt receive mail sent there, to generate such a circumstance.

    BUT this only matters if you want to pay it,. Any collection over 4-5 years old has minimal negative effect any longer.

    I have found that getting a 6 year old collection deleted gave no score increase at all!

    So, It all depends on the situation. You may have a late payment on a credit card within the last 12 months which is far more damaging to your credit score!

    And yes, they have to have records indicating they attempted to call and mail you at least a few times.

  4. I think they do have to inform you, but there’s next to no way for you to prove they didn’t try.

    My husband got a collection notice from our university saying that he had some unpaid fees, three years after he graduated – this is from a school that swears you can’t graduate or get transcript (which he did) copies when you owe them money.

    We argued that the charges were invalid – I mean how did they not find them for years?? We argued that we were never informed by the university that this money was owe – which we weren’t. None of that mattered. They swore we owed it, so we finally gave up and paid it. The legal fees to fight wouldn’t have been worth it.
