  1. Depends on State law, and you don't say where you are.

  2. Depends what you are talking about. If you are referring to an HID Kit then yes. If you are referring to a Factory equipped Vehicle with HID's then no. You may get away with retrofitting a set of projectors, ballasts, and bulbs from a factory equipped vehicle but it is still illegal.
