If someone takes out an insurance policy, without telling the insurance company that they had been disqualified in the past from driving - say 4 years ago, and then has an accident and makes a claim, is the insurance company able to check with the DVLA a drivers past history?

This person also has a duplicate copy of a clean licence from the past.

  1. Most insurance contracts give the insurer permission to look into your past history.  You have to give this permission if you want coverage.

Many insurers do full underwriting up front and would catch this around the time of application.  Others rely on your answers but investigate at time of claim.  With the permission you gave when applying.

If this person has somehow omitted facts on the application or has lied ... that will likely void the contract ... and possibly be a fraudulent offense.
