  1. Technically, if you're serving to the public... you need a permit and a health ticket.

For a child's lemonade stand, the cops or health department won't even bother going out and checking up on that type of stuff.

Edit... in regards to the story out of Naples, FL (2003)

It appears that the 6 y.o. mom spun this story to make the city look bad and to s***w her neighbor...

    The mom was able to

    1) get people (suckers) to donate money to her daughter's college fund.

    2) s***w her neighbor by implying that she's some type of witch.

Of course, the mom and daughter probably made some money going to interviews on national TV and radio stations.  They're 15 minutes in the spotlight.

The mom liked the noteriety... "Avi's almost made more money than I have in the last three weeks."

  2. O' Reilly actually did a news story on this http://www.sptimes.com/2003/07/17/State/...

  3. probably, considering that it's a food item prepared by individuals who probably aren't servesafe certified, and they're selling goods without a business license, but I would be hard pressed for some cop or government officials running up on a stand 5 deep with papers shutting down the operation.  Could you imagine a health dept. guy inspecting a lemonade stand?

Cop,  "Excuse me, ma'am, do you have your health card?"

Cute lil girl, "25 cents, please" (enter dimples and irresistable smile)

  4. you have to have a permit

  5. You probably have to check w your town.

But here in fla kids have them all the time where I live.

I would hope they wouldnt take away simple town amercia..every child in america has wanted mom to make one once in their lifetime.
