Are The Police/Firemen Responsible For Damages To Your Property When They Come To You?

I was just wondering about this... if the police and/or fireman have to break down your door or window to get to you in your residence, are they responsible to pay for the damages done?

  1. No they do not.  If they are in the wrong however (such as the wrong house) the city will pay for it.


  2. No they're not liable.

    Most States ect will have a "good will or good faith" clause in a law or power etc that allows emergency services to be exempt from being held liable for damages arising from performing their duties in an emergency.

  4. If called to an emergency they have control over the house.

    If it is necessary to damage the house to enter or to put out the fire, then there is no liability attached.

    If they are at the wrong address then there is liability.

    If they broke into the wrong house you can get the damage repaired at the expense of the city.

  5. If the Police/Fire Department have a legal right (i.e. search warrant service/injured person inside that can't reach the door) to enter your house then they are not liable for damages.  They can not negligently break things but they are allowed to damage things when it is needed to carry out their duties.
