Question:

Are braces considered a medical expense in arkansas for a parent who pays half of medical expense?

My insurance does not cover cosmetic things like braces, but It was my ex-wife who got my daughter braces with talking to me at all. Since its a cosmetic issue I don't thnk i should be required to pay half the expenses.

I agree with you.  She should have consulted you first in this decision if she expects you to pay half.  However braces can be done for medical reasons.  For instance if her speech is impaired, trouble eating/chewing foods, pain in jaws, etc due to the placement of the teeth and even some are claiming emotional health issues if the teeth are causing low self-esteem.  However, the orthodontist would have first had to contact the insurance company for approval if the braces were deemed a medical necessity.  Something that may be on your side is that your ex should have had to sign papers at the ortho's office stating that she will pay for the braces and to sign off on the treatment plan.  So the office should be billing her for future payments.  Not sure if that will help you out legally or not.
