Are legal fees related to a divorce the biggest consumer rip-off in the USA?

It seems as if NY, and other states, have determined that the desire to leave a bad marriage should be likened to a crime worthy of legal process that requires more legal time and fees --and in many cases punishment-- than murder. Consumers have no recourse at all. NY's attorney general refuses to investigate the excesses of NY's divorce lawyers and fraudulently markets himself as "The People's Lawyer" when he is really the "Lawyer's Lawyer"--he ignores the biggest consumer fraud perpetrated in his state.

  1. What you have to remember is that lawyers go through tens of thousands of dollars in money to obtain an education.  The real issue is not the cost of the lawyer, bu the time in the case.  All family court/divorce court lawyers have a horrible tendency to try and make a case last as long as humanly possible to extend the amount of chargeable hours.  Thus, the issue is not in the fees but the time.  In all areas of law, fees for a lawyer can range from 200-1000 dollars per hour of case work.  Remember, no one forces anyone to go to court for a divorce case, all divorces can be resolved without a lawyer or a trial, it is the husband and wife's choice to bring the case before a judge.


  2. It is the people involved in the divorces who make the fees so high. Two people with common sense and fairness can take care of the situation without attorneys. This is not often the case though, so you pay the "big bucks" to try to get things "your way".

    You do not have to use them. Most divorces do not use them.

    Hire a mediator to settle the divorce.

  6. Most lawyer's fees are not, "let's make a deal". It's usually " This is my fee. Take it or leave it."

    And if you're seeing one in the first place, you are seldom in a position to say " I'll leave it."
