A payday loan is an agreement entered into by two parties - the borrower and the lender.  If the terms of that agreement are not met by either side there may be a CIVIL cause of action.  In no instance would an unpaid loan be criminal unless perhaps the person obtained the money by providing false information on the loan application or through some other means of deception or fraud.
